3. Client Responsibilities

Clients engaging our services agree to:

• Provide accurate, complete, and timely information necessary for billing operations.
• Maintain current medical licenses, certifications, and credentials.
• Ensure compliance with all applicable healthcare laws and regulations.
• Notify us promptly of any changes to practice information, staff, or payer contracts.
• Execute required Business Associate Agreements (BAAs) in compliance with HIPAA.

4. HIPAA Compliance

MedTrueCare operates as a Business Associate under HIPAA regulations. We implement administrative, technical, and physical safeguards to protect Protected Health Information (PHI). All services are conducted in accordance with HIPAA Privacy and Security Rules.

5. Fees and Payment Terms

Service fees are determined based on the scope of services agreed upon in individual contracts. Payment terms, billing cycles, and fee structures will be outlined in separate service agreements.

Clients are responsible for:

• Timely payment of invoices as specified in service agreements.
• Any bank fees, late payment charges, or collection costs incurred.

6. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of MedTrueCare Billing or its licensors and is protected by copyright and intellectual property laws.

7. Confidentiality

8. Limitation of Liability

• Delays or denials caused by payer policies or system errors beyond our control.
• Losses resulting from inaccurate or incomplete information provided by the client.
• Changes in healthcare regulations, payer requirements, or coding guidelines.

Our total liability for any claim arising from our services shall not exceed the fees paid by the client for the services in question during the preceding six months.

9. Indemnification

Clients agree to indemnify and hold MedTrueCare harmless from any claims, damages, or expenses arising from:

• Inaccurate information provided by the client.
• Client's violation of applicable laws or regulations.
• Unauthorized use of our services.

10. Termination

Either party may terminate the service agreement with written notice as specified in the contract. Upon termination:

• All outstanding fees become immediately due.
• MedTrueCare will return or securely destroy client data as requested.
• Confidentiality obligations remain in effect.

11. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

• Good faith negotiation between the parties.
• Mediation, if negotiation fails.
• Binding arbitration in accordance with applicable laws.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

13. Modifications to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated to clients via email or posted prominently on our website. Continued use of our services after changes constitutes acceptance of the updated Terms.
